This terms of service agreement (the “T&Cs”, “Terms”) is a legal agreement between you (“you”, “your”, or “customer”) and Gooberr (“we”, "us", "gooberr", the “company”), the owner and operator of the website (the “site”) and the related retail stores (“retail”). This agreement states the terms and conditions that govern your use of the site and application of all services, retail stores, features, gift cards, credits and resources available or enabled via the site and/or applications (collectively, with the site and applications, the “services”), and your purchase of products and goods sold through our services. By accessing and using any of the services, you are indicating that you accept, and agree to comply with, this agreement. If you do not accept this agreement, you are not permitted to, and you must not, access or use the services or purchase products from goober. Or any of its subsidiaries. Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms.

Accessing & Using This Site |
By signing up for a Gooberr account or shopping online or at a Gooberr Retail Store, you represent, acknowledge and agree that you are at least 18 years of age, or if you are under 18 years of age but are at least 13 years old, that you are using the Site with the consent of your parent or legal guardian and that you have received your parent’s or legal guardian’s permission to enter into this Agreement. If you are a parent or legal guardian who is registering for a child, you hereby agree to bind your child to this Agreement and to fully indemnify, release and hold harmless gooberr if your child breaches or disaffirms any term or condition of this Agreement. Where you create a user account and password, you must treat such information as confidential, and you must not disclose it to any third party. We reserve the right to disable any user account at any time, if in our opinion you have failed to comply with any of the provisions of these Terms.
Customers agree to provide accurate, current, and complete information as required for the purchase of the Products and Services (both as defined below under"Terms of Sale"). Gooberr reserves the right to block further sales to Customers who provide false, inaccurate or incomplete data. Customer acknowledges that Gooberr uses a third party payment processing service to process orders and bill fees to your credit, debit, or other Company accepted payment method (“Payment Method”).
Terms of Sale |
Sales of Products and Goods to End Users Only: Gooberr sells edible products, clothing, accessories, and other related goods and supplies (the “Product(s)”) to end-user customers who purchase Products (“Goods”) only for their own personal, non-commercial use. You may not purchase Products or Goods for further distribution or resale or for any other commercial or business purpose.
Pricing for Products and Goods (including any applicable shipping and handling fees) can be found on Goober's then-current pricing page located on the Site. The price that we will charge you for the Products and Goods will be the price as posted on the Site or in Retail on the date you successfully placed an order on the Site. Gooberr reserves the right to change prices for Products and Goods at any time, and does not provide price protection or refunds in the event of promotions or price decreases.
Gooberr accepts various Payment Methods. You agree to pay all fees charged to your account based on Gooberr’s fees, charges, and billing terms in effect as shown on the payment page when you check out from the site with the Products you wish to purchase. You are also responsible for paying any sales and use taxes and shipping and handling fees that may apply to your purchase of Products or Goods based on the address that you provide as the shipping address when you register for a Gooberr account, and you authorize Gooberr or the third-party payment processing service provider that we engage to charge your Payment Method for any such taxes and fees. All payments shall be made by your selected Payment Method in advance prior to shipping the Products. If you do not pay on time or if your Payment Method cannot be charged for any reason, Gooberr reserves the right to either suspend or terminate your account, cancel your order, redirect or request abandonment of the delivery of the Product and terminate these Terms of Service. All sales and payments will be in Singapore dollars. Gooberr and Gooberr's third-party payment service provider may receive updated Payment Method information from your credit card or payment method issuer. The disbursement of the updated Payment Method information is provided to Gooberr and Gooberr's third party payment service provider at the election of your credit card and payment method issuer. Neither Gooberr nor Gooberr's third-party payment service provider is responsible for the distribution of your credit card or payment method information. It is at the sole election of your credit card or payment method issuer. Your credit card or payment method issuer may give you the right to opt-out of the update service. It is your responsibility to contact your credit card or payment method issuer with regard to your right to opt-out of the update service.
Prohibited Activities |
You agree and undertake not to: - use the Site for illegal purposes or other than in conformance with the acceptable use policies of any connected computer networks, any applicable Internet standards and any other applicable laws; impersonate any person or entity or to falsely state or otherwise misrepresent your affiliation with any person or entity;

The Site may contain links to third-party websites that are not affiliated with or owned, operated, or controlled by Gooberr, including third party payment system providers. You acknowledge and agree that Gooberr is not responsible for the content, privacy policies, or practices of such third-party websites or the companies that own them. By using the Site, you expressly relieve Gooberr from any and all liability arising from your access and use of any third party website.

The Site, its services and all information provided herein are provided on an “as is” and “as available” basis without warranties of any kind, either expressed or implied, other than those imposed by law, including but not limited to warranties of title or implied warranties of merchantability, satisfactory quality, fitness for a particular purpose or non-infringement.
Without limiting the generality of the foregoing, we expressly disclaim any warranty, condition, guarantee, term or representation (i) as to the reliability, accuracy, completeness, and validity of any content or material on the Site; (ii) that the functions contained on the Site will be secure, uninterrupted or error-free; and (iii) that any defects will be corrected. Any and all such warranties, conditions, terms and representations are specifically excluded. We assume no responsibility for errors or omissions in the materials on the Site, including factual or other inaccuracies or typographical errors. You expressly agree that your use and/or access of the Site is at your sole risk.
Without prejudice to the generality of the foregoing, we expressly disclaim any and all liability arising from:- life or wear of any Product or that it will be suitable for any particular purpose or use under any specific conditions, notwithstanding that such purpose or conditions may be known or made known to Gooberr; improper remedy of defective products, alteration of the products, unsuitable or improper use, wilful damage, negligence, or other misuse of the products, as well as fair wear and tear, by you or any third party; third party claims, whether directly or indirectly caused by, or relating to, the content of our Site and the products purchased on or through our Site; and any warranties provided under these T&Cs if the total price for the Product has not been paid in cleared funds by the due date for payment.
You further acknowledge and agree that your access and use of the Site is dependent on third-party service providers such as internet, network, connectivity or other link providers. Your payment for any Product purchased from the Site is processed by third party payment system providers and Gooberr does not retain or process any such payment information. Gooberr cannot guarantee the security of such third party payment system(s) or any payment data on the Site, Gooberr is not responsible for any acts or omissions of any third parties and disclaims any and all liability in connection with the acts, omissions or defaults of such third parties. Without prejudice to the generality of the foregoing, Gooberr is not responsible for the results of any credit inquiry, the availability or performance of the Internet, your connection to the Internet or the actions or inaction of any other person or entity, including any internet service provider. By using the Site, you expressly relieve Gooberr from any and all liability in connection with the acts, omissions or defaults of such third parties.

We may change any content or material on the Site at any time. Any of the content or material on the Site may be out of date at any given time, and we are under no obligation to update the Site. We shall not be liable if for any reason the Site, or any portion thereof, is unavailable at any time or for any period. We reserve the right to refuse any and all current or future access to and/or use of the Site without prior notice to you.
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.
